This document sets forth the terms and conditions for using the Biodiversitate.com online store ("the Store"). Accessing and using the website implies acceptance of these terms.

Biodiversitate.com.com SRL is the company that administers the domain https://biodiversitate.com/ (hereinafter referred to as "the SITE"). Biodiversitate.com.com SRL, hereinafter referred to as the COMPANY, is a commercial entity organized under Romanian law, with its registered office at Str. 22 Decembrie 1989, no. 304, Zalău, Sălaj, Romania, with tax code: 51279601 and Trade Registry number: J2025010063003.

The COMPANY reserves the right to modify and update the content of the SITE at any time, including the terms and conditions of use, prices, and product details, without prior notice. We recommend checking this section periodically to stay informed of any changes.

Within this document, terms used in the singular include the plural and vice versa, and genders are used interchangeably, without discrimination.

All information used to describe products on the SITE (images, videos, multimedia presentations, etc.) is provided for informational purposes only and does not constitute contractual obligations on the part of the COMPANY.

Promotions and offers displayed on the SITE are available only for a limited period and while stocks last.

The terms and conditions of use may be updated periodically, and any modification becomes effective and binding for all USERS/CUSTOMERS upon its publication on the SITE.

• BUYER: A natural person, commercial company, or legal entity that places an ORDER.
• CLIENT: A natural or legal person who owns or obtains access to the content of the SITE by any means of communication made available by the COMPANY or based on a usage agreement.
• SELLER: Biodiversitate.com SRL, as a provider of products and services through the SITE.
• GOODS AND SERVICES: Products or services (including documents and related services) mentioned in the ORDER, supplied by the SELLER to the BUYER according to the CONTRACT.
• CONTRACT: A distance agreement concluded between the SELLER and the BUYER, without the need for the simultaneous presence of both parties.
• ORDER: An electronic document through which the BUYER expresses their intention to purchase GOODS and SERVICES through the SITE.
• SPECIFICATIONS: Descriptions and characteristics of the GOODS and SERVICES available on the SITE.
• INTELLECTUAL PROPERTY RIGHTS: Intangible rights, including know-how, copyrights, patents, trademarks, databases, and domain names.
• ACCOUNT: A protected section of the SITE, created by the CLIENT for managing orders and personal data.
• CAMPAIGN: A promotional action carried out by the SELLER, offering a limited number of products/services at special prices.
• NEWSLETTER: An electronic method of periodic information about products, services, and promotions offered by the COMPANY.
• SITE: The domain www.biodiversitate.com and all its subdomains.
• ABUSIVE USE: Any use of the SITE contrary to commercial norms, applicable legislation, or in a manner that may cause damage to the COMPANY.

• Access to place an ORDER is allowed to any CLIENT/USER. However, the COMPANY reserves the right to restrict a CLIENT/USER's access to placing an ORDER or to certain payment methods if there are justified reasons, such as a history of behavior that could cause damage to the COMPANY. In such situations, the CLIENT/USER may request information regarding the decision made.

• By placing an ORDER on the SITE, the CLIENT expresses agreement with the communication method used by the COMPANY (by phone or email) for carrying out the operations.

• An ORDER not confirmed by the COMPANY has no contractual value. The notification received by the CLIENT immediately after placing the ORDER is purely informative and does not constitute its confirmation. Confirmation will be made later, electronically or by phone.

• In justified situations, the COMPANY reserves the right to modify the quantity of PRODUCTS in an ORDER. In this case, the CLIENT will be notified by email or phone, and the amount paid will be adjusted accordingly.

• The CONTRACT between the COMPANY and the CLIENT is considered concluded when the CLIENT receives ORDER confirmation from the COMPANY.

• The documents and information presented on the SITE constitute the basis of the CONTRACT concluded between the COMPANY and the CLIENT.

How to Place an Order on Biodiversitate.com

1. Select desired products
   • Navigate through product categories in the main menu or use the search bar to quickly find items of interest.
2. Add products to cart
   • From the product page, select the desired options (quantity, variant, if applicable) and click the "Add to cart" button.
   • You can continue shopping and add more products to your cart.
3. Check and modify cart contents
   • Access the shopping cart by clicking on the shopping cart icon at the top right of the page.
   • Here you can update the quantity of products or remove unwanted items.
4. Apply a discount code (if you have one)
   • Enter the promotional code in the "Discount code" field and click "Apply" to see the updated price.
5. Log in or create an account
   • If you are a new customer, create an account by filling in the necessary details.
   • If you already have an account, log in using your email and password.
6. Choose delivery method
   • Select the desired option from the available delivery methods, if applicable.
   • If you need a different delivery address, check the "Use a different address" option and enter the details.
7. Select payment method
   • Select the desired option from the available payment methods, if applicable.
8. Review and confirm order details
   • Make sure your billing and shipping addresses are correct.
9. Complete the order
   • Click the "Place order" button to finalize your purchase.
   • You will receive a confirmation email with your order details.

Order confirmation does not equate to contract conclusion. The sales contract is considered finalized only upon issuance of the tax invoice by Biodiversitate.com SRL.

• Prices are expressed in LEI (RON) and include VAT.
  The COMPANY reserves the right to modify product prices without prior notice.
  In case of pricing errors displayed on the site, you will be notified and will have the option to accept the correct price or cancel the order.

• Accepted payment methods:

  • Cash on Delivery - up to 600 Ron.

  • Bank Transfer - for online payments, your bank may charge currency conversion fees (if you use a card issued in another currency).

• Delivery is made by Cargus - Express Courier.

• Estimated time: 10 days from placing the order. Parcels will be picked up by the courier from our warehouse only on Mondays, Tuesdays, and Wednesdays to prevent plants from getting stuck in the logistics center over the weekend!

• The delivery fee is 35 lei and is borne by the client.

• According to art. 10 letter c of O.G. 130/2000, we reserve the right not to accept the return of products which, by their nature, cannot be returned or which may rapidly degrade (perishable) or deteriorate.
